In a landmark move, the Haryana Reservation Amendment Bill, 2024, has been passed to amend the Haryana Scheduled Castes (SC) and Backward Classes (BC) (Reservation in Services and Educational Institutions) Act, 2016. This bill signifies a significant step towards ensuring equity and inclusivity in the state’s public services and educational institutions.

Background:
The impetus for this amendment stems from the directive issued by the Government of India on May 9, 2016, which included seven castes – Ahirwal, Ahdi, Hedi, Thori or Turi, and Raisikh – in the Scheduled Caste list under the Constitution (Scheduled Castes) Order, 1950. Consequently, these castes were removed from Haryana’s Other Backward Classes (OBC) list, as the lists of Scheduled Castes and Other Backward Classes cannot overlap.

 Key Amendments:
– The Bill replaces the term “Nayak” with “Lopit” and repositions “Raisikh” to replace “Nayak” in Block-A of the BC category list.
– Additionally, it substitutes the entry at serial number 31 with “Joginath, Jogi Nath, Jangam, Yogi” to ensure accuracy and representation.
– Furthermore, it proposes the removal of the “Sain” caste from serial number 29 and introduces it as a separate entry at serial number 72 in the BC category list.

Impact:
These amendments align Haryana’s reservation policies with constitutional mandates and address historical disparities faced by marginalized communities. By providing equitable opportunities in public services and educational institutions, the state aims to foster social cohesion and empower underprivileged sections of society.

Haryana Appropriation (No. 2) Bill, 2024

The Haryana Appropriation (No. 2) Bill, 2024 has been passed to authorize payments and appropriations totaling INR 237,184,86,60,286 from the consolidated fund of the state of Haryana for services during the fiscal year 2024-25, ending on March 31, 2025.

Haryana State Sports Association (Registration and Regulation) Bill, 2024

For the protection of athletes and sports associations, the Haryana State Sports Association (Registration and Regulation) Bill, 2024 has been enacted to establish the Haryana Sports Registration Council and the Regional Sports Registration Council. These councils will regulate the registration and regulation of sports associations and related matters at both the state and regional levels.

The government is keenly aware that some sports associations operating at the district and state levels are involved in inappropriate practices harmful to the interests of sports and athletes. In the absence of specific legislation, the state government feels legally obligated to regulate such matters.

The objective of the Haryana State Sports Association (Registration and Regulation) Bill, 2024 is to establish regulatory bodies at the state and regional levels to oversee the registration and regulation of these sports associations, with the primary aim of promoting a sports culture in the state while safeguarding the interests of athletes and sports.

These councils will also have the authority to investigate complaints against sports associations and their officials to ensure adherence to fair sporting practices.

Additionally, the bill outlines the responsibilities of district and state-level sports associations, including organizing championships, providing training facilities, maintaining records, and submitting required information to the regulator. It also specifies the consequences of registration and deregistration.

The bill aims to streamline the functioning of sports associations, enhance accountability, increase transparency, and promote the development of sports in the state of Haryana.

Haryana Project Land Consolidation (Special Provisions) Amendment Bill, 2024

The Haryana Project Land Consolidation (Special Provisions) Amendment Bill, 2024 has been enacted to amend the Haryana Project Land Consolidation (Special Provisions) Act, 2017. The main purpose of the amendment is to introduce special provisions for the consolidation of land parcels leftover from projects or related matters under the said Act.

The original Act was amended by the Haryana Project Land Consolidation (Special Provisions) Amendment Act, 2020, replacing Section 3 of the original Act with ‘taken into possession or acquired by the government’ before ‘seventy percent.’

Haryana Dignified Disposal of Dead Bodies Bill, 2024

The Haryana Dignified Disposal of Dead Bodies Bill, 2024 has been enacted to ensure the preservation of fundamental human rights concerning the disposal of dead bodies in the state of Haryana and related matters.

Under Article 21 of the Indian Constitution, the right to life includes the right to dignity and proper treatment not only during a person’s lifetime but also after death. Recognizing the dignity and respect owed to the deceased is a recognition of human dignity.

While ensuring the right to dignity and respect for deceased persons, it is necessary to ensure that no person uses or permits the use of a dead body for any protest or agitation against any demand, taking into account the rights and dignity of the deceased.

This bill, the Haryana Dignified Disposal of Dead Bodies Act, 2024, provides provisions for the dignified and timely disposal of dead bodies and, in cases where family members reject a body, mandates that such bodies be disposed of by the public authority for the final rites and is necessary for associated or ancillary matters.

The passage of the Haryana Reservation Amendment Bill, 2024, underscores the state government’s commitment to inclusive governance and social justice. By recognizing and rectifying historical injustices, Haryana paves the way for a more equitable and prosperous future for all its citizens.
