The Supreme Court has granted interim relief to Rajbir Singh Ghuman, Officer on Special Duty (OSD) to Punjab Chief Minister Bhagwant Singh Mann, by directing that no coercive action be taken against him in a corruption case being investigated by the Central Bureau of Investigation (CBI).

The relief, however, does not mean that the case has been quashed or that the investigation has been halted. The court declined to stay the CBI\u2019s First Information Report (FIR), allowing the investigation to continue while the legal challenge proceeds.

A bench of Justices M.M. Sundresh and Prasanna B. Varale issued notice on the Punjab government\u2019s petition challenging a Punjab and Haryana High Court order directing the CBI to register a case and investigate allegations linked to the Chief Minister\u2019s Office. The Supreme Court also indicated that the state must cooperate with the investigation.

What is the case against the Chief Minister\u2019s aide?

The case centres on allegations that government postings, transfers, administrative decisions, tender conditions, licensing matters and land-related issues were influenced in exchange for illegal financial benefits.

The CBI registered the FIR on October 5, following directions from the Punjab and Haryana High Court and after receiving material from the Enforcement Directorate (ED). Ghuman and five other named individuals have been booked in the case, along with references to unknown public servants and private persons.

According to the CBI, the allegations include attempts to influence the postings of IAS and IPS officers, departmental proceedings, policy formulation, administrative approvals, licensing decisions, land-use conversions, property disputes and revenue-related matters. The agency has also alleged that drafts of government orders and policies were accessed and provided to private individuals before their official release. These are allegations under investigation and have not been established as proven offences.

The Punjab and Haryana High Court ordered the CBI investigation after considering material placed before it in proceedings arising from a public interest litigation. The petition had raised concerns over the handling of allegations previously communicated by the ED to Punjab Police authorities.

Punjab government challenges the High Court order

The Punjab government approached the Supreme Court to challenge the High Court\u2019s direction for a CBI investigation. The state\u2019s petition argues against the order that led to the registration of the case and seeks judicial intervention in the matter.

The Supreme Court\u2019s latest order provides temporary protection against coercive action for Ghuman, but leaves the FIR intact. This distinction is significant: the agency can continue investigating the allegations even as the legal questions surrounding the probe are examined by the courts.

Ghuman has also challenged the CBI\u2019s actions in separate proceedings, questioning the legality of the FIR and searches. Among his objections is the claim that prior approval required under Section 17A of the Prevention of Corruption Act was not obtained. That argument is a legal contention made by Ghuman and remains subject to judicial consideration.

CBI searches and summons add to the controversy

The case intensified after the CBI conducted searches at multiple locations, including the camp office allotted to Chief Minister Bhagwant Mann in Chandigarh and premises associated with Ghuman and other accused persons.

The agency said electronic devices and documents had been seized for examination. Investigators are examining material they believe may be relevant to the alleged corruption and influence-peddling network.

Ghuman did not appear for questioning on an earlier date, with Chief Minister\u2019s Office sources saying that he had not been formally served the summons. The CBI subsequently pasted a summons outside his residence after he failed to appear for questioning as directed.

Mann alleges political targeting

Chief Minister Bhagwant Mann has rejected the allegations and accused the BJP of using central investigative agencies to target his government ahead of the next Punjab Assembly election. He has maintained that his government is prepared to face any investigation and has described the allegations as politically motivated.

The controversy has therefore developed on two fronts: a criminal investigation into allegations of corruption and a political dispute over the role of central agencies in Punjab. The state government\u2019s challenge to the High Court order has also raised questions about the legal basis and scope of the investigation.

The CBI, for its part, is proceeding on the basis of the High Court\u2019s directions and the material referred to it. The allegations against Ghuman and the other accused will need to be tested through the investigation and any subsequent judicial proceedings.

What the Supreme Court\u2019s order means

The immediate consequence of the Supreme Court\u2019s order is that Ghuman has protection against coercive action for the time being. But the court has not cancelled the FIR, declared the allegations baseless or closed the investigation.

The legal battle over the CBI probe will continue alongside the agency\u2019s investigation. The case is likely to remain politically sensitive because it involves an aide to the Punjab Chief Minister and allegations concerning the alleged use of official influence in government decisions.

For now, the Supreme Court\u2019s intervention offers Ghuman interim protection while leaving the central question unresolved: whether the allegations can be substantiated through evidence and whether the investigation has been initiated and conducted in accordance with the law.<\/p>\n\n\n\n
