In a significant development, the Supreme Court has granted bail to Aam Aadmi Party (AAP) leader and Rajya Sabha member Sanjay Singh, who was labeled as the “main conspirator” by the Enforcement Directorate (ED) in a money laundering case. Singh, while not directly implicated in the alleged Delhi excise policy scam, faces accusations of legitimizing proceeds from the purported scam. Drawing parallels with Delhi Chief Minister Arvind Kejriwal’s legal battles, Singh’s case has become a focal point in the ongoing political drama.

The bench comprising Justices Sanjiv Khanna, Dipankar Datta, and P B Varale heard the arguments in the case, where senior advocate Abhishek Manu Singhvi represented Singh. Singhvi argued that there is no concrete evidence against his client and emphasized that the ED failed to adhere to the necessity test in Singh’s arrest.

Justice Khanna raised pertinent questions during the proceedings, demanding clarification from the ED regarding their failure to attach any assets belonging to Singh under investigation. The court questioned the rationale behind Singh’s continued incarceration for the past six months, prompting the ED to express no objection to granting him bail.

The court further warned the ED that any opposition to bail would necessitate a consideration of bail under the Prevention of Money Laundering Act (PMLA). Notably, if bail were granted under Section 45 of the PMLA, it would imply that the primary allegations against Singh are not substantiated, potentially weakening the ED’s case.

Dinesh Arora, a prominent businessman, is at the center of the controversy, with the ED alleging his involvement as the intermediary between the South Group and AAP in financial transactions. The ED claims that Arora orchestrated discussions between Singh and several restaurant owners, arranging for a ₹82 lakh check to be included in the party funds for the upcoming elections. Additionally, Singh is accused of receiving ₹2 crore in cash through his associate Sarvesh Mishra, who also faces charges under the PMLA.

Singh’s arrest is seen as part of a broader crackdown on corruption in Indian politics, echoing Kejriwal’s past legal battles. Kejriwal, too, faced accusations of involvement in money laundering but was ultimately acquitted due to lack of substantial evidence.

As the legal battle unfolds, Singh’s case has become emblematic of the challenges faced by politicians in navigating India’s complex political landscape. The allegations against Singh underscore the broader issue of corruption in politics, raising questions about accountability and transparency in governance.
